Responsibilities of Tire Producers
A “tyre producer” is the one who manufacture and supply new tyres in the country or export or import new tyres through other producers or suppliers or import waste tyres for their use in new vehicles sold in the country. In order to obtain an EPR certificate, the producer must register with a certified recycler and submit the certificate online as a quarterly return as provided under rule 7 of the Amendment Rules, the producer must meet his EPR targets. A recycler is someone who converts used tires into useful products which are eco-friendly like recycled carbon black, crumb rubber, crumb rubber modified bitumen or pyrolysis oil/char. According to rule 8 of the amendment act, the producers have to also inform the CPCB as to how many old tyres they have used and how many new products they have produced from it in a month.

Duties of the Tire Manufacturers and Importers.
• If you manufacture or import tyres for the year 2020 and 2021 then the tyres to be made or imported should be 35% of what will be required to be manufactured or imported for the years 2022 and 2023.
• By 2023-2024, it should be 70% of what you made or earned in the period of 2021-2022.
• These will be the number of tires you manufactured or imported in a given year of 2022-2023 and this will be the number that you will be expected to manage for the years 2024-2025.
After the year 2024-2025, you have to dispose off all the tires that you have produced in 2022-2023.
It means that if you established your factory after April 2022, then for that year you have to manage all the tires which you produced or you have imported in the previous year.
• If you are to bring in waste tyres, then you have to handle all the waste tyres from the previous year.
• In case of delaying waste tyres management you are allowed to postpone the responsibility for one year but only for the number of tyres that were delayed.
Penalties and Compensation
If producers or recyclers do not adhere to the new rules then they will have to pay penalty for the non-compliance according to the Central Pollution Control Board’s Extended Producer Responsibility (EPR) regulations.
If someone provides false information for EPR certification, creates a fake EPR certification for more than 5% of the actual recycling or if he/she breaches the rules, then he/she will be jailed for 5 years, fined upto one lakh rupees or both. The CPCB make these rules to ensure that the producers and recyclers are doing their part in the right manner.
